Station Casino sues online gambling company

Station Casino has filed a lawsuit in U.S. District Court against Smart Answer, a Panama-based online gambling company. Casino claims Smart Answer is committing trademark infringement by using domain names with trademark terms such as "boundary station", "Ilmol station" and "Gungjung station". The domains then redirect web users to Golden Casino, Smart Answer's Internet gambling website.

The complaint states that the defendants in the case are violating federal law on cyber-squeting by using domain names that are deceptively similar to the station's trademark. The lawsuit also alleges violations of state law prohibiting deceptive trading practices. The lawsuit seeks an injunction to prohibit Smart Answer from using such trademarks and seek unspecified damages.

"Defendants' actions are, among other things, intended to disrupt or disrupt plaintiffs' business by moving web users to defendants, an online gambling website linked to the plaintiffs' website and infringing domain name," Stations said in a lawsuit filed by Jason Firth to the Las Vegas law firm Brownstein Hyatt Faber Schreck.

Smart Answer was sued by MGM Mirage last year by using casino labels Bellagio, Circus Circus, Mandalay Bay, New York-New York, and Treasure Island to do the same. The company did not respond to the complaint and MGM was awarded $2.2 million in damages, along with a provisional injunction.

The MGM lawsuit succeeded in transferring or closing the infringing domain to MGM Mirage, but did not receive any of the rulings. According to Perth, who handled the case, MGM is not actually raising funds because of the related costs.
