New York Offers Downstate Q&AS First Round

This week, the New York Gambling Regulator released its first question-and-answer session from Downstate Casino applicants, which revealed matters related to candidates in the early stages of the process. The 103 page report in the state discussed all regulatory measures and procedures required by 11 casino applicants seeking one of the three fully available gaming licenses.

The three licenses available for the Downstate region cost $500 million each, so they are on track to earn $1.5 billion almost immediately. This amount must be paid by the successful bidder, which is also required to invest $500 million in capital investment. The winning bid must be announced by the end of 2023 or early 2024.

Applicants are concerned about a wide range of topics, from building and licensing costs to community advisory committees and planned diversity efforts. The report was published by the New York State Game Commission and the gaming facility location committee and covers 613 inquiries from January 3 to February 3, 2023. The next question is due on October 6.

However, the NYSGC did not provide a timeline for when the second question would be answered by the state. The five-month hiatus between the scheduled first question and the GFLB's response also raised some concerns. Meanwhile, the state expects Downstate casinos to generate thousands of new jobs, millions of local taxes and billions of gaming revenue.

Earlier this year, Senator Joe Adabbo of D-Queens said the earlier the three licenses are issued, the sooner the state will start receiving compensation from them. These include thousands of construction and post-construction jobs, billions of revenue from licenses, rising problematic gambling funds and programs, and more money for education funding.

Meanwhile, Empire State is expanding, increasing pressure on national officials to act quickly, with pre-tax revenue from its four-class III gambling facilities reaching $338.7 million in 2023, up 2.73% from the first half of 2022, and online sports betting is also rampant.

Recently, some parents in New York City expressed concern that their children could be used as pawns by casino bidders for downstate licenses. In August, Las Vegas Sands, one of the licensing candidates, filed a zoning application with Hempstead Town in connection with its proposed casino bid. The application revealed details of a $1 billion project to build a casino on 396,726 square feet and provide parking and garage on 3.9 million square feet.
