Michigan Tribe Continues To Expand Athletics Casino
For more than a decade, the Chippewa Indians' Saul St. Marie Tribe (SSM Tribe) has been working to expand its land-based presence with the development of two new casinos. The Tribe currently operates five Kewadin casinos around Michigan's Upper Peninsula, but has been seeking to expand to Lansing and New Boston.
The SSM Tribe's efforts included the purchase of land from two of the aforementioned sites back in 2012. At the time, the tribe purchased 2.3 acres of land in Lansing as well as 71 acres in New Boston. Ultimately, the land was expected to be used by the tribe for a new casino that is expected to bring economic stimulus.
According to the SSM tribe, the land at both sites was purchased through a self-sufficiency fund. Although the tribe asked the U.S. Department of the Interior (DOI) to take the land needed to build the casino to the trust, the agency refused. The DOI rejected the tribe's request to take the land to the trust in 2017, citing the Michigan Indian Land Claims Resolution Act (MILCSA). At the time, the agency explained that under MILCSA, the tribe could not use the self-sufficiency fund for gambling activities.
There's a legal battle going on
SSM Tribe, which disagreed with DOI, opened the lawsuit in 2018. It said the agency's decision violates MILCSA and could stifle further growth and wellbeing. However, DOI's decision was later reaffirmed by U.S. District Judge Trevor N. McFadden.
However, as published by Play Michigan, the SSM tribe did not abandon its legal fight. A recent episode of the lawman saw the tribe raise the issue with the DC Circuit Court. The SSM tribe, in its legal argument, asked the circuit court to overturn McFadden's ruling, which reaffirmed that the DOI was right to refuse to trust the land under the MILCSA.
If the DC Circuit Court overturns the ruling, the tribe could finally achieve a significant milestone in the planned expansion of its land-based portfolio. In this case, the land must be trusted, paving the way for the development of two new sites for planned tribes in Lansing and New Detroit.
